Terms of service

1. Who this is between
These terms are between TWENTYTWELVE, a sole proprietorship registered in Singapore (UEN 53470445W) (“we”), and the photographer or studio holding the account (“you”). Sukimiya FrameFlow is our product.
2. What the service does
We host an online gallery for an event. You upload photographs; your guests can add their own by scanning a code, without an account. We show the gallery, record view and favourite counts, and let you download the files.
3. Your photographs stay yours
You keep copyright in everything you upload. Guests keep copyright in what they upload. You grant us only the licence we need to run the service: to store, resize, and display those photographs in your gallery, and to make backups. That licence ends when the content is deleted. We will not use your photographs to promote Sukimiya FrameFlow unless you tell us in writing that we may.
4. Guest uploads, and who is responsible
Anyone with the gallery link or QR code can add photographs. That is the point of the product, and it is also a risk you take on when you switch it on.
- You decide whether guest uploads are enabled, and you can turn them off at any time.
- You are responsible for the content of your gallery, including what guests add.
- We may remove any content, at any time, without your permission, if it is illegal, sexual, abusive, infringing, or the subject of a valid removal request from someone who appears in it. We will tell you when we do.
- We may suspend guest uploads on a gallery while we look into a report.
5. The people in the photographs
This is the part that matters most, and it is genuinely your responsibility rather than ours.
- You decide whose photographs go into the gallery and who can see it. Under Singapore's Personal Data Protection Act you are the organisation responsible for that personal data. We process it on your behalf as a data intermediary.
- You confirm you have the right to upload what you upload, and that the people in it, or their parent or guardian where they are children, have been told their photographs will appear in an online gallery.
- Galleries are unlisted, not private: anyone with the link can open one. We ask search engines not to index them, but a link you or a guest shares publicly is public. Tell your client this.
- If someone asks us to remove a photograph of themselves, we will remove it, and we do not need your agreement to do so.
6. Plans, payment and what you get
- Prices are in Singapore dollars and shown on the pricing page.
- Per-event purchases unlock one gallery. Pro is a monthly subscription you can cancel at any time, effective at the end of the paid month.
- The Free plan does not keep full-resolution originals. Only web-resolution copies are stored. Paying later cannot recover an original that was never kept. This is stated in the app before you upload, and it is worth repeating here.
7. How long a gallery lasts, and when photographs are deleted
Because we really do delete things, here is the timetable:
- A gallery is visible to guests for the period your plan provides (7 days on Free, 90 on Per-event, a year on Pro).
- After that it is hidden, not deleted.
- Files are kept for a further 30 days, during which reactivating restores the same link. After that they are permanently deleted.
- We email you before a gallery goes offline and once it has. Keep your email address current, and do not treat Sukimiya FrameFlow as your only copy of a client's photographs.
8. Refunds
If the service fails and we cannot fix it, tell us within 14 days and we will refund the event or the current month. We do not refund a gallery that ran as intended, or one deleted after its retention window because it was not renewed.
9. What we promise, and what we do not
We take reasonable care: the service is backed up daily and backups are restore-tested. We do not promise uninterrupted availability, and we are a small operation rather than a large hosting company.
You must keep your own copy of every photograph you care about. To the extent the law allows, our total liability is limited to what you paid us in the previous 12 months, and we are not liable for indirect or consequential loss.
10. Suspension
We may suspend or close an account that breaks these terms, particularly section 4 or 5, or that is used to distribute illegal content.
11. Changes and governing law
We will email you before materially changing these terms. They are governed by the laws of Singapore, and the courts of Singapore have jurisdiction.
